This Agreement becomes effective from the moment of your consent to its terms upon registration at 4pitstop

1. Subject of the Agreement

The User Agreement is a legally binding contract and regulates the relations between the administration of the internet resource 4pitstop, located at 4pitstop, (hereinafter referred to as "administration" or "4pitstop") and an individual (hereinafter referred to as "user"), who uses the site to obtain, publish, or search for information.

2. Description of Services

2.1. 4pitstop is a public information and communication service and provides its services under the terms that are the subject of this User Agreement (UA). The Agreement may be changed by us without any special notice. The current edition of the UA is located at user agreement.

 

2.2. After registration, you will receive personal disposal of disk space for placing texts, photographic materials, messages, or information related to or referring to programs, music, sounds, photographs, graphic images or videos (hereinafter referred to as "content"). The content is hosted on the administration's servers.

 

2.3. You understand and agree that all services are provided "as is" and that 4pitstop is not responsible for any delays, failures, incorrect or untimely delivery, deletion, or failure to store any user's personal information.

3. Your Registration Obligations

3.1. In order to use the services of the 4pitstop resource, you agree to provide true, accurate, and complete information about yourself as prompted by the registration form, and to maintain and promptly update this information to keep it current.

 

3.2. If you provide any information that is untrue, inaccurate, not current or incomplete, or if the administration has serious reasons to suspect that such information is untrue, inaccurate, not current or incomplete, the administration has the right to suspend or terminate your registration and refuse any and all current or future use of the 4pitstop internet resource (or any part thereof) without prior notice and explanation of reasons.

 

3.3. During the registration process, you will specify a login and password for access to the personalized part of 4pitstop. You are responsible for the security of your login and password, as well as for all that is done on 4pitstop under your login and password. The administration has the right to prohibit the use of certain logins and/or remove them from circulation. You agree that you are required to immediately notify the administration of any unauthorized (not permitted by you) access with your login and password and/or any breach of security, and that you independently perform the termination of work under your password (the "exit" button) at the end of each session of working with the site. The administration is not responsible for the possible loss or damage of data that may occur due to your violation of the provisions of this part of the UA.

4. User Behavior Policy

4.1. You understand and accept that you are responsible for any and all information (content) — data, text, programs, music, sounds, photos, graphics, videos, messages, and other materials, posted for public access or transmitted privately — created by you. This means that you, and not the administration, are fully responsible for all content that you upload, send, transmit or otherwise make available via 4pitstop.

 

4.2. The user agrees that content posted on 4pitstop will be available to all other users, both directly on the site and through broadcasting by various technical means with reference to the original source (via email distribution, RSS feed, use as an electronic postcard, screensaver, blog entry, etc.).

 

4.3. The administration does not control the content transmitted through the 4pitstop services, and therefore does not guarantee the accuracy, completeness, or quality of this content. You understand that by using the services of 4pitstop, you may encounter content that is offensive, indecent, or controversial. Under no circumstances is the administration responsible for the content created by users of 4pitstop.

 

4.4. Rights to all content posted on 4pitstop are considered to belong to the users who posted it, unless there is a reason to believe otherwise. Users do not obtain any rights to use the content of other users beyond the capabilities provided by 4pitstop and are fully responsible to the author for the unauthorized use of content.

 

4.5. The user independently bears responsibility to third parties for their actions related to the creation and placement of content on 4pitstop, including ensuring that the content complies with the laws of Ukraine and does not violate the rights and legitimate interests of third parties. The content and each of its elements must not violate copyrights, rights to trademarks, means of individualization, and/or rights to other intellectual property belonging to third parties. The user independently and at their own expense undertakes to settle all claims of third parties related to the creation and placement of content on the 4pitstop internet resource.

 

4. User Conduct

4.6. You agree not to use 4pitstop for:

• Uploading, sending, transmitting, or any other way of posting content that is illegal, harmful, threatening, morally offensive, infringing on copyright, promoting hatred and/or discrimination against people based on race, ethnic origin, gender, religious, social characteristics, containing insults to specific individuals or organizations;
• Violating the rights of minors and/or causing them harm in any form;
• Infringement of minority rights;
• Impersonating another person or representative of an organization and/or community without sufficient rights, including impersonating administration employees, forum moderators, website owners, and also misleading regarding the properties and characteristics of any subjects or objects;
• Uploading, sending, transmitting, or any other way of posting content that you do not have the right to make available under the law of Ukraine, or according to any contractual relationships;
• Uploading, sending, transmitting, or any other way of posting content that affects any patent, trademark, trade secret, copyright, or other proprietary and/or author's and related rights of a third party;
• Uploading, sending, transmitting, or any other way of posting unauthorized advertising information, spam (including search spam), lists of other people's email addresses, "pyramid" schemes, multi-level (network) marketing (MLM), internet earning systems, and e-mail businesses, "chain letters", as well as participation in these events (sending unsolicited letters with links to services provided by the administration) can be considered participation in the prohibited activities of this section, even if the sending was done without the direct use of 4pitstop servers);
• Uploading, sending, transmitting, or any other way of posting any materials that contain viruses or other computer codes, files, or programs designed to interrupt, destroy, or limit the functionality of any computer or telecommunications equipment or programs, for unauthorized access, as well as serial numbers for commercial software products and programs for their generation, logins, passwords, and other means for obtaining unauthorized access to paid resources on the Internet, as well as posting links to the aforementioned information;
• Intentional violation of local, Ukrainian law, or international legal norms;
• Collection and storage of personal data of other individuals;
• Disruption of the normal operation of the 4pitstop website;
• Use of any forms and methods of illegal representation of other individuals on the network;
• Posting links to network resources whose content contradicts the current legislation of Ukraine;
• Assisting in actions aimed at violating the restrictions and prohibitions imposed by the agreement.

 

4.7. You acknowledge that the administration is not obligated to review any type of content before posting, and that the administration has the right (but not the obligation) at its discretion to refuse to post or delete any content available through the 4pitstop website. You agree that you must independently assess all risks associated with using content, including assessing its reliability, completeness, or usefulness.

 

4.8. The content of the 4pitstop internet resource may contain links to other resources. You acknowledge and agree that the administration is not responsible for the availability of these resources and their content, as well as for any consequences associated with the use of these resources.

 

4.9. You understand that the operation of the services may require the transmission of your content through computer networks, and also its modification to comply with technical requirements.

 

4.10. You agree not to reproduce, duplicate, copy, sell, or resell, nor use for any commercial purposes any parts of the 4pitstop site, except in cases where such permission is granted to you by the administration in writing. By registering, you receive a non-transferable right to use your registration (login and password) to access your personal information. You do not have the right to transfer your registration (login and password) to third parties, nor do you have the right to receive it from third parties, except with written consent from the administration. The administration is not responsible for any agreements between you and third parties.

 

4.11. You agree that all content posted by you on 4pitstop, including texts, photographic materials, comments, messages on forums and other communication services are stored in databases (including publicly accessible ones) and are not removed at the user's request. The complete deletion of information from the site is carried out in exceptional cases and only by the decision of the administration.

 

4.12. You agree not to use any artificial methods to simulate, accelerate, or alter user actions on the website. Violation of this clause of the UA will lead to the immediate deletion of the account without warning and the possibility of recovery.

 

4.13. By entering into this Agreement, you grant the administration a royalty-free, non-exclusive license to use all content (including public comments) published by you on 4pitstop, globally for the entire duration of the exclusive rights to the content from the moment of publication, by processing, making it generally known, distributing, and including in complex objects with the right to sublicense and use without naming the author or under a pseudonym. Your content may be used in its original or modified form on any internet sites, including for advertising purposes.

5. Rights and Obligations of the Administration

5.1. The administration has the right to place advertising information or any other information for public dissemination on the page with your content, however, without harming the content of your web page. The form, order, and volumes of such information may change from time to time by the administration.

 

5.2. You agree that the administration reserves the right to terminate your login and password and delete any content for any reason, including non-use of access or violation of the UA. Specifically, your registration will be deleted if you have not used it for more than 3 months from the date of your last visit. The administration is not responsible for terminating access to 4pitstop.

 

5.3. The administration is committed to taking comprehensive measures to protect the user's registration data from unauthorized access, destruction, or alteration of the information posted by the user, as well as from other unlawful actions of personal information in its possession, using technical means;

 

5.4. Any content posted by users can be used by the administration for further distribution both with the indication of their authors and without it, without the need to obtain special permission from the user.

6. Property Rights

6.1. You acknowledge and agree that the 4pitstop internet resource and all necessary programs associated with it, contain confidential information that is protected by intellectual property laws and other Ukrainian and international laws, and the content that you provide during the use of services is protected by copyrights, trademarks, patents, and other relevant laws. Except as provided by the administration, you agree not to modify, sell, distribute this content and programs, in whole or in part.

 

6.2. The administration grants you a personal, non-exclusive, and non-transferable right to use the software provided on the 4pitstop internet resource on a single computer, provided that neither you nor any other persons with your assistance will copy or modify the software; create programs derived from the software; penetrate the software to obtain program codes; engage in the sale, lease, transfer to third parties in any other form of rights to the software services provided to you under the UA, as well as modify the services, especially for the purpose of obtaining unauthorized access to them.

7. Disclaimer of Warranties

7.1. You understand and agree that:

• You use the 4pitstop internet resource at your own risk. The services are provided "as is". The administration does not assume any responsibility, including for the suitability of the services for the user's purposes;
• The administration does not guarantee that: the services will meet your requirements; the services will be provided continuously, quickly, reliably, and without errors; the results that can be obtained from using the services will be accurate and reliable; the quality of any product, service, information, etc., obtained using the services, will meet your expectations; all errors in the programs will be corrected;
• Any materials obtained by you using 4pitstop can be used at your own risk, and you are responsible for any damage that may be caused to your computer and your data as a result of downloading these materials;
• The administration is not responsible for any direct or indirect damages that have arisen due to: the use or inability to use the services; unauthorized access to your communications; statements or behavior of any third party in the services;

8. General Information

8.1. Due to the free nature of the services provided under the UA, consumer protection laws cannot be applicable to it. In case the UA is made payable, appropriate changes will be made to comply with these laws.

 

8.2. Nothing in the UA can be construed as establishing between you and the administration any agency relationships, partnerships, joint venture relationships, personal hiring relationships, or any other relationships not explicitly provided for in the UA.

 

8.3. The recognition by a court of any provision of the UA as invalid or unenforceable does not lead to the invalidity or unenforceability of other provisions of the agreement.

 

8.4. Inaction by the administration in case of violation by you or other users of the provisions of the UA does not deprive the administration of the right to take appropriate actions to protect its interests later, nor does it signify a waiver by the administration of its rights in the event of subsequent similar or related violations.
